1. Introduction & Acceptance of Terms

Welcome to MyVigator, Inc. (“MyVigator,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our websites, training services, financing programs, immigration and placement services, and all related platforms (collectively, the “Services”). By accessing, using, or registering for our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

Our Services are intended for individuals who are at least 18 years of age and legally capable of entering into binding contracts. By using the Services, you represent and warrant that you meet these eligibility requirements. You are responsible for providing accurate, complete, and up-to-date information during the registration process and throughout your participation in our program.

3. Services Provided

MyVigator, Inc. offers a comprehensive pathway to global healthcare workforce mobility. Our Services include, but are not limited to:

  • Training Programs: Specialized preparation for licensing exams, such as the NCLEX-RN. Future offerings may include preparation for USMLE/MCCQE/AMC exams for medical graduates.
  • Deferred Financing: Arrangements to cover the costs of training, exams, licensing, and relocation.
  • Licensing & Credentialing Support: Assistance with the complex process of verifying credentials and applying for professional licenses in the destination country.
  • Placement Assistance: Facilitating employment with our network of partner employers in countries including Canada, the U.S., and Australia.
  • Immigration Support: Providing guidance and assistance with visa and immigration applications.

4. Deferred Loan & Financing Terms

Your participation in our program may include a Deferred Loan Agreement. The terms and conditions of this loan are as follows:

  • No Upfront Costs: MyVigator covers the cost of training and other program-related expenses.
  • Deferred Repayment: Repayment obligations begin only after you have been successfully placed in a job and have received your first paycheck.
  • Interest Rates: Interest rates are capped and tiered based on the repayment term:
    • 10% APR for a 3-year term.
    • 12.5% APR for a 4-year term.
    • 15% APR for a 5-year term.
  • Ethical Policy: In the event that you are discontinued from training due to sustained lack of commitment or other predefined causes, you will have no repayment obligation for the costs incurred.

5. Candidate Responsibilities

By participating in the MyVigator program, you agree to:

  • Attend and complete all assigned training sessions and modules.
  • Actively and responsibly prepare for all scheduled licensing and professional exams.
  • Participate honestly and professionally in all aspects of the Services.
  • Promptly notify MyVigator of any changes to your personal, contact, professional, or immigration status.
  • Maintain a high standard of professionalism and ethical conduct.

6. MyVigator Rights

We reserve the right to:

  • Discontinue Services for any candidate who fails to demonstrate sufficient commitment, professionalism, or fails to meet the program’s requirements.
  • Modify, suspend, or terminate any part of the Services as required by law or business needs.
  • Protect and enforce our intellectual property rights, including all trademarks, copyrights, and proprietary training materials.

7. Placement & Employment

MyVigator facilitates employment opportunities but does not guarantee employment in a specific location, facility, or role. Final hiring decisions are made by the employer and are not within our control. We are not responsible for the terms of your final employment contract, which is an agreement between you and the employer.

8. Data Protection & Privacy

The collection and use of your personal information (including your name, passport, national ID, and academic/professional records) are governed by our Privacy Policy. By using our Services, you consent to this collection and use for the purpose of providing our Services. We comply with applicable data protection laws in all countries where we operate.

9. Limitation of Liability

To the maximum extent permitted by law, MyVigator, Inc. is not liable for any direct, indirect, incidental, or consequential damages, or any other damages of any kind, arising from or in connection with the use of our Services. This includes, but is not limited to, delays or denials in professional licensing, immigration visa applications, or employer hiring decisions.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms to our website. We will indicate the date of the last revision at the top of this page. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
